Challenging state regulation of climate policy
On August 5, 2024, the NAM filed an amicus brief in support of the petitioners’ request that the Colorado Supreme Court overturn the lower court’s refusal to dismiss climate change litigation brought by Boulder County and the City of Boulder. We argue that the subject matter and remedies sought through this litigation are inherently national, as well as legislative and regulatory in nature—such complex policy matters should not be decided by state courts under state liability laws.
