Protecting Against Liability for Conduct of Foreign Actors

On March 27, 2026, the NAM filed an amicus brief in the Tennessee Supreme Court arguing against extraterritorial application of Tennessee law to incidents occurring in other countries. In this case, a Tennessee manufacturer was sued for alleged injuries suffered by agricultural workers in the Dominican Republic. Not only did the plaintiffs’ failure-to-warn claims lack factual support, but they sought redress under the wrong laws. Dominican law governs injuries that occur in the DR—not Tennessee law. Our amicus brief argues for a strong presumption against extraterritoriality for international civil cases. Tennessee statutes cannot be manipulated by plaintiffs’ lawyers to sue Tennessee companies for conduct that occurs in other countries at the direction of foreign actors. A contrary finding would leave Tennessee manufacturers susceptible to endless litigation for conduct beyond their control and burden state courts with claims that have little to no connection to the state.
